Terms of Service

These Terms of Service ("Terms") are an agreement between you and Bar Fun Finder LLC, a Minnesota limited liability company ("Bar Fun Finder," "we," "us"). They apply to our mobile app, website and owner dashboard (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who can use the Service

You must be at least 21 years old to create an account or use the Service. You agree that the information you give us is accurate and that you will keep it up to date. If you are using the Service for a business or charity, you confirm you have authority to act for it.

2. Your account

You are responsible for activity on your account and for keeping your sign-in details secure. Tell us right away if you think someone else has used your account. You can delete your account at any time from the Profile screen in the app. We may suspend or end accounts that break these Terms or harm other people or the Service.

3. What the Service is, and is not

Bar Fun Finder is an informational directory. We list bars, events, specials, jobs and charitable games that bars and charities tell us about.

• We do not operate, host, run or sell any gambling, raffles, pull-tabs, bingo, meat raffles, paddlewheels, or similar games.
• We do not accept wagers, sell tickets or chances, hold money for players, or pay out prizes.
• Any charitable gambling listed is organized and run by licensed charitable organizations and the venues that host them, who are solely responsible for following the law, including licensing, age and location rules.
• Listings may be wrong, out of date or canceled. Always confirm details with the bar or organization before you go. We are not responsible for what happens at any venue or event.

4. Drink and play responsibly

Alcohol and gambling can be harmful. Do not drink and drive, and do not drink or gamble if you are under the legal age. If gambling is a problem for you or someone you know, free, confidential help is available in Minnesota by calling or texting 1-800-333-HOPE (4673).

5. Your content

You may upload a profile photo and other content to your account. You keep ownership of it, and you give us a limited, non-exclusive license to store and display it as needed to run the Service. Do not upload anything that is illegal, harmful, hateful, sexually explicit, or that belongs to someone else. We may remove content that breaks these rules.

6. Acceptable use

You agree not to: break the law or these Terms; scrape, copy or resell our data; interfere with or try to break into the Service; use the Service to harass others or to send spam; pretend to be someone else; or post false or misleading listings.

7. Text messages

If you turn on text alerts, you agree to receive recurring text messages from us about the bars, events and alerts you chose. Consent is not a condition of using the Service. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time, or HELP for help. You can also turn texts off in the app. Carriers are not liable for delayed or undelivered messages.

8. Bars, charities and advertisers

Bars, charities and advertisers may buy subscriptions, event boosts, sponsor placements and other promotional products. Payments are processed by Stripe and are also subject to Stripe's terms. Prices, features and any separate partner or advertising agreement will be shown to you at the time of purchase. Unless an agreement or the law says otherwise, purchases are non-refundable once a promotion has started. We do not guarantee any number of views, visits, customers or sales. Promoters are responsible for the accuracy and legality of their listings and ads.

9. Sponsor ads

The Service may show ads from sponsors. Sponsors are responsible for their own ads, and we do not endorse them.

10. Third-party services and links

The Service relies on and may link to third-party services such as Google, Apple, Stripe and venue websites. We do not control them and are not responsible for them. Your use of them is governed by their own terms.

11. Our property

The Service, including the Bar Fun Finder name, logo, design and software, belongs to us or our licensors and is protected by law. We give you a personal, limited, non-transferable license to use the app for its intended purpose. You may not copy, modify, reverse engineer or sell it.

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose and non-infringement. We do not promise the Service will be uninterrupted or error free.

13. Limit of liability

To the fullest extent the law allows, Bar Fun Finder LLC and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service or anything that happens at a venue or event listed on it. Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.

14. Indemnity

You agree to defend and hold us harmless from claims, losses and costs (including reasonable attorneys' fees) that come from your content, your breach of these Terms, or your violation of any law or third-party right.

15. Governing law and disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Ramsey County, Minnesota, and you agree to their jurisdiction. Before filing a claim, please contact us at the email below so we can try to resolve it informally.

16. Apple App Store

If you downloaded the app from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the app and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Changes

We may update these Terms from time to time. When we make important changes, we will update the date at the top and, where appropriate, notify you in the app. If you keep using the Service after a change, you accept the new Terms.
